Accused Fred’s Store Shooter’s Trial Continued To December

FORT PAYNE, Ala. (WHNT)-- The trial for Kelly Jack Mayo in connection to a shooting at the Rainsville Fred's store has been continued.   Defense attorneys asked for a delay for more psychiatric testing of Mayo.

Mayo is charged with two counts of attempted murder in connection to the August 2012 shooting.  Investigators say Mayo shot into the store at closing time because he was a disgruntled former employee.   Matthew Whitt and Josh Nance, who were working that night, were shot.  Nance is paralyzed from the waist down.

Mayo's new trial date is set for the second week of December.   He's pleaded not guilty by reason of mental disease or defect.
