According to our news partners The Huntsville Times/al.com, the arrest warrant for Desiree Dawn Childers, 27, alleges her 8-month-old daughter was placed in the bathtub fully clothed. The girl, Blakely Alexandria Fairburn, drowned.

The defense claims there are irregularities with Childers’ arrest. Attorney Patrick Hill questions why Childers is being held on such a high bond on a non-capital offense.

“It is my intention to have these questions answered at the bond hearing on September 19,” Hill told The Huntsville Times/al.com.

Fairburn died August 30. Childers was arrested September 3 after an investigation by Madison Police.  The incident happened at a home on Oak Brook Circle.
