Huntsville Police upgrade assault charges to murder stemming from October shooting

HUNTSVILLE, Ala. – Huntsville Police have charged Billy Cardwell, 38, with murder in the October 18 shooting death of Phillip Montague. Three other people were injured in the shooting.

Officers responded to the area of Medaris Road around 12:45 a.m. They believe there to have been an altercation between several people that led to shots being fired. Four victims of the shooting arrived at Huntsville Hospital while officers were still looking for the crime scene.

Phillip Montague, 18, died at the hospital.

Cardwell was arrested on November 6 on assault warrants stemming from the incident. Investigators with the Huntsville Police Department and the Madison County District Attorney’s Office determined charges should be upgraded. Cardwell was served with a warrant for murder yesterday while still in the Madison County Jail.
