MADISON, Ala. (WHNT) – Judge Schuyler Richardson has approved a motion to dismiss the Failure to Report Child Abuse charges filed against John Nash, the former Discovery Middle School Band Director.

Nash was accused of violating Alabama’s mandatory reporting law. That accusation involved Nash’s son, John Bradley Nash, who volunteered with the band at Discovery Middle School in Madison.  Bradley later pleaded guilty to child pornography charges.

Last week, District Attorney Rob Broussard filed a motion to dismiss the criminal charges against John Nash. That motion asked the judge to enter an order of Nolle Prosse, saying the State “cannot prove the allegations in the matter beyond a reasonable doubt.”

Judge Richardson approved the motion Wednesday evening.

Nash officially retired from the Madison City Schools system after being placed on leave during his legal proceedings.
