MOBILE COUNTY, Ala. – A complaint filed in federal court claims numerous Alabama officials violated the 14th Amendment rights of those seeking a marriage license today after a federal stay expired, effectively making same-sex marriage legal in Alabama.
The complaint comes from Mobile County, where couples seeking a marriage license were told that the Probate Court would not open the marriage license office.
The suit names Governor Robert Bentley and Attorney General Luther Strange as defendants, as well as Alabama Chief Justice Roy Moore, claiming that they failed to execute the federal court’s order to issue marriage licenses to all couples starting Monday.
An emergency injunction is requested to force Alabama officials to open marriage license offices and issue licenses to all who request one.
No word yet on when the judge may rule.
