DECATUR, Ala. - A man shot by an off-duty deputy is suing the Morgan County Sheriff's Office.

An off-duty Morgan County Sheriff's deputy shot this man, David Horton, at a Huntsville Wal-mart in April 2015. Horton is now suing the Sheriff's Office.

Deputy Brian Fulford shot David Horton outside a Huntsville Walmart in April of 2015.  Horton's lawyer says Fulford was shopping and recognized Horton as having an outstanding warrant.

Horton's lawyer says Fulford confronted his client who ran away.  Fulford then shot Horton.  The deputy told Huntsville Police his weapon accidentally went off.

An independent review board looked at evidence from the shooting and determined Fulford did not follow protocol.  He resigned a few days later.
