MOBILE, Ala. (AP) — An Alabama man accused of killing a 2-year-old boy who he was trying to potty-train last year is now facing the death penalty.

Local media outlets report that 31-year-old Willie Anthony Burton was booked into the Mobile County Jail on Monday under an increased charge of capital murder. Burton had earlier been charged with child abuse and murder and had been out on bond since last month.

In court documents obtained by Al.com , authorities say Burton beat his girlfriend’s son while teaching him to use the toilet last August. The child later died at a hospital. Autopsy reports showed injuries from blunt force trauma.

Burton has returned to jail and is not eligible for bail. No date has been set for his hearing.
