TUSCALOOSA, Ala. (AP) – A judge has dismissed domestic violence charges against a one-time Tuscaloosa police officer after his wife asked to end the case.

The Tuscaloosa News reports the decision came after prosecutors and the defense filed requests to drop charges against 35-year-old Jimmy Darrell Smith.

Smith was charged with domestic violence and other crimes in 2014 after what authorities described as three separate incidents involving his wife. The couple had been married a month at the time, and they’ve remained married.

A prosecutor wrote in a court document that the woman changed her story and asked that the charges be dropped. He said the couple’s continuing relationship makes prosecution impossible.

Defense lawyer Jason Neff says there’s no evidence a crime occurred.

Smith resigned from the Tuscaloosa Police Department following his arrest.
