Decatur City Prosecutor files motion to dismiss charges against Rolando McClain

MORGAN COUNTY, Ala. (WHNT) – Decatur City Prosecutor Emily Baggett filed a motion to dismiss charges against Rolando McClain.

The misdemeanor charges against the pro football player were disorderly conduct and resisting arrest. McClain was arrested during an incident in April 2013 at Pines Park when officials say he refused to leave the park after a large crowd gathered and began cursing at the officers.

McClain’s attorney Carl Cole argued that using expletives toward the police is not illegal and that no crime was committed.

McClain’s trial was scheduled for May 18.

The motion filed Monday states the city does not wish to proceed with this case. A circuit court judge still needs to sign the motion.
