MOBILE, Ala. (AP) – Federal investigators say a man has been arrested in the death of his 8-year-old daughter who was found on a deserted road in mid-September.

FBI Special Agent Jessica Foran says 38-year-old Hiawatha Robinson was arrested Tuesday on charges of murder and sodomy.  It’s unclear if he has an attorney.

Prosecutors say the girl died of “homicidal violence” at the hands of her father, according to our news partners AL.com.

“The facts will show that while engaging in sodomy in the first degree, Hiawatha Robinson Jr. caused the death of Hiawayi Robinson,” Mobile County District Attorney Ashley Rich said Tuesday.

Under Alabama law a person may face charges of first-degree sodomy if he or she engages in “deviant sexual intercourse” with a person less than 12 years old.

“Deviant sexual intercourse is defined in the law of the state of Alabama as sexual gratification involving the sexual organs of one person and the mouth or the anus of another person,” Rich said.  She declined to comment on whether abuse of the child by her father had been ongoing, AL.com reported.

Investigators have said the body of 8-year-old Hiawayi Robinson of Prichard was found on a road behind an abandoned building September 18, two days after she was reported missing.

The father is being held in the Mobile Metro Jail.  He is due in court Wednesday morning.
