LIMESTONE COUNTY, Ala. (WHNT) - Joel Moyers, accused of capital murder in Limestone County, has pleaded not guilty.

He had a hearing Wednesday morning. His attorneys have tried several times to get the capital murder charges dropped, but have been unsuccessful so far.

Moyers, 53, has been behind bars for more than a year. Now, new court documents show Moyers is seeking a dismissal of the case citing double jeopardy as the reason.  His attorneys further argue the prosecution also violates his constitutional rights.

Moyers is charged in connection with the 2012 death of Brandon Hydrick.

Someone please explain to me how this is double jeopardy? He hasn’t gone before a judge or a jury to face the charges of murder. He’s a weasel who is trying to get out of the fact that he shot and murdered someone. I pray that Brandon’s family and dear Bronwen find peace, and I know that will never happen with this idiot running free. He murdered Brandon in cold blood, he took a young and promising life out of this world. Also I might point out that he has not been behind bars for over a year. He was arrested a year ago and let out on bail (where he went to his mothers property on Smith lake) for several months before being brought back in. At best he has been behind bars for 8 months.
