Attorney Asks for Dismissal of Civil Suit Against Former UAH Provost

HUNTSVILLE, Ala. (WHNT) – The attorney representing former UAH Provost Vistasp Karbhari has asked a judge to dismiss the civil suit against his client in connection with the  February 2010 UAH shootings.

Attorneys argued that because Amy Bishop had confessed her guilt to the murders, there was no legal basis for claiming that Karbhari was in any way responsible.

In February of 2013, the plaintiffs in the civil suit requested hundreds of documents, phone records and other evidence for their case.  UAH said that the cost to provide these documents would exceed $1 million, an unreasonable amount.

Ray Garner’s statement:

“A motion for summary judgment has been filed seeking dismissal of all claims against former UAH Provost Vistasp Karbhari. As stated in Defendant Karbhari’s supporting memorandum, the uncontested facts show there is no legal basis for claiming that Dr. Karbhari was in any way responsible for the death of the victims of Amy Bishop’s senseless act of violence. The guilty party in this case is the confessed murderer, Amy Bishop. The loss of life resulting from this shooting was, and is, a terrible tragedy for the victim’s families, and for the university where they were dedicated and valued members of our faculty as well. The tragedy should not be compounded, however, by continuing this lawsuit against an innocent man.”
