Decatur Police say they took John Augustine, who is the child's father but did not have custody of the girl, into custody.  He was spotted in the parking lot of the Decatur Mall Thursday evening after investigators say he took off with the girl leading to a state-wide alert from authorities. They had considered the child to be in imminent danger.

Eyewitnesses told WHNT News 19 police surrounded Augustine in his parked Honda Pilot with guns drawn.

“All a sudden a cop car pulls up and they jump out of a car they are yelling at him and the cop pulls out a gun and says put your hands on the car," Brenda Allen said.

The child was turned back over to her mother. Police are still investigating.
