Could the NFL Punish McClain?

The NFL's personal conduct policy has been used to punish players beyond what the legal system does to them.  

Could this course of action apply to former Decatur and Crimson Tide standout Rolando McClain?

The Oakland Raiders linebacker practiced with his team this week for OTA's.  His coach did not say definitively if the franchise will punish him but the league has come out saying they will review the matter.
