Section High School Football Coach Arrested on DUI, Other Charges

SECTION, Ala. (WHNT) – Section High School’s football coach was arrested overnight on several charges, including driving under the influence.

An Alabama State Trooper stopped Joey Kirby in the Rosalie community for speeding on Alabama 71, the same highway where the school is located.

Kirby refused a field sobriety test.  The trooper charged Kirby with DUI and also charged him with reckless driving, saying he was going 91 miles per hour in a 55 mph zone.

Troopers say Kirby is also charged with having an open container of alcohol and illegal possession of an alcoholic beverage.  More charges are pending, troopers said.

Kirby was booked in the Jackson County Jail. We’re told he is being held for 24 hours, and will be released after 10 p.m. Wednesday.

WHNT News 19 has contacted Jackson County School Superintendent Ken Harding for comment.  He has not returned our phone calls.

Kirby started coaching at Section High School in the fall of 2011. His brother is an assistant coach.  Section’s football team went 6 and 4 in 2013.

      Pat you have noooo idea what kind of “role” model he is to the kids…He uses such bad profanity that he has been ask to step down by several parents and he refuses…It is an embarrassment….First the principal was arrested for stealing newspapers and now this…

    His wife teaches at Pisgah and is just as bad. Both are a disgrace to the teaching profession. She cusses in front of the kids and doesn’t do her job at all!

      Mrs. Kirby was my children’s teacher a few years ago. They enjoined her class. They always talked about the fun they had learning from her. You cannot judge a person or teacher by a mistake their spouse made.

    Section is a fine community full of mostly wonderful, smart, talented people. It was a great place to grow up. I attended school there with a lot of caring teachers. Do not let one event with one person make you think this little place isn’t amazing. Some of the best people I know were born & raised right there. I don’t defend the person or the actions, but I do stand up & defend the town. Please don’t attack the town in your comments.

    Mrs. Kirby is my childs teacher and has always gone above and beyond to help in any way and has always been a dedicated professional. Our community is a wonderful place and a great place to send your children to school. I see no need in bashing someone for the job they do because their spouse made a mistake. Is what this man did wrong? Yes! Is it her fault? NO! Wouldnt it be great if we were all perfect?

      My son is also in Mrs. Kirbys class. He comes home everyday saying she is his favorite teacher. He says she makes learning fun, he also says that he loves Mrs. Kirby and she is a great teacher. He has learned alot from her this year and has really enjoyed her and her class. I think people should lay off her she has done nothing wrong.

      Amen! The only difference between him and a lot of other people is he got caught. Who are we to judge him! Many spend so much time bashing others when we all should be looking at our own imperfections!!!

    We all make mistakes. Let’s pray that this man learns a valuable lesson. Also, pray for his innocent family. I’m sure they are emotionally distraught. Rude and hateful comments are only going to make it harder for them.

    Yes, we should pray for mr. Kirby , his wife and kids. What he did was wrong but we are all humans and we all mess up. But to bash his wife whom I know personally is so wrong. She is an awesome teacher and mom, how about showing her some support instead of misplaced hate.

    So what? Kirby is human just like you and me. Coach Kirby was a great teacher when I had him. He’s the reason I graduated. History and I didn’t click. He helped me make it click to pass my graduation exams
    He will learn from his mistakes. I just hope this doesn’t completely ruin him especially they way some of you are acting.

    Be very careful when reading that. This makes it sound like he was arrested because he refused the test. Sounds manipulative coming from the the police. From the Alabama DUI Defense’s web site:

    “Unless you are under 21 or on parole, you have the right to refuse a roadside breath test in Alabama. It is 100% voluntary, and there are no penalties for refusing a roadside breath test; however, you could face administrative penalties for refusing the official breath test administered at the police station.”

    You have the right to refuse a roadside breath test without penalty, HOWEVER, it says he refused field sobriety tests. That means he refused the approved tests(one leg stand, HGN, and walk and turn). If you refuse those the officer has to go based on observations such as driving behavior, odor of alcoholic beverage, red eyes, slurred speech, etc. You normally go to jail if you refuse all those tests.

    Please know the law before you try to say the officers were trying to manipulate law. It only makes you look bad.

      Jean, the reason this guy went to jail was probably because he did have all those cases. The odor, red eyes, etc. Not because he refused the tests. Any DUI defense lawyer will tell you not to take those tests. They CANNOT help you. Why would someone willingly give the police evidence to convict them? It’s like talking to them without a lawyer or consenting to a search, don’t ever do it. You’d be surprised at how many people can’t pass those tests stone cold sober.

      If someone is arrested then yes, a blood or urine test at the station is required. Refusing that specific test can result in your license being suspended. I stand by my statement though. The way the story is reported is sketchy based on the order of the sentences.

    The tests are not pass/fail. Look it up. In all my years, I have never seen a sober person have any problems with the tests. How many years have you been in law enforcement?

    Most stone cold sober people will take the tests to prove they are innocent. I’m sure that the trooper just didn’t pick this guy outta the thousands on the roadway to arrest. Seems sketchy that folks take up for the guy driving drunk that could kill u or your children. If u read the updates u will see where he was driving 91mph in a 55mph zone. I’m sure it was the combination of evidence and events that led to his arrest. Glad he didn’t hit me head on. Hope the best for all involved.

    Guys, this behavior runs ramped in the county! Others just do not get caught or are tied in to the police. If it would have been a county police officer then you would not be reading about this. It just happened to be a trooper that pulled him over. I walked into a Mexican restaurant in one town in our county and there were coaches drinking at the bar right after a spring practice last week. Right in the middle of town! It blew my mind. There are also reports that some of those same coaches were in a bar fight in Scottsboro. It seems like some schools or one certain school encourages coaches to behave this way. Its crazy, do not crucify this man. He made a mistake that most of all of us have made if our life. He got caught. The police arrested him. He will have to pay his due. A few years ago a coach at one of our county schools was arrested for DUI and he had some pills on him. He did not get fired. So if they do fire him, he will have grounds to school the system.

    @lionnation: Are u saying that a county or city wouldn’t have arrested him? The troopers usually don’t play favorites when it comes to DUI. I no a few troopers that have arrested city and county police for DUI. Also heard of one trooper arresting a trooper for it. I guess after seeing 100’s of dead bodies at wreck scenes caused by drinking they become hardened.

      That is what I am saying. Troopers do not mess around, but if it would have been a county policeman then the story would have never been heard about. They would have let him go or followed him home because they knew who he was or the officer was friends or family with him or someone else at the school. “The good ol boy” system. The guy made a mistake, he was arrested and will pay his due. I think it will be a good testimony for him for the rest of his career when it comes to kids who play for him. Maybe it is what he needed to humble him a bit. Now he will be a better role model for young people and hopefully a example of “Hey guys I have made a lot of mistakes, but we can all over come those mistake, learn from them and move forward.” In other places of the county things are much worse. You got whole coaching staffs out in the middle of the town drinking and fighting and they do not try to hide it. Coach Kirby will pay his dues and the state police will see to that. Does not make him a monster like everybody is trying to make him out to be. There has only been 1 perfect person to every walk this earth and I know he loves coach Kirby and I know what he would tell us all to do. Love and forgive and help him.

    WE AS A FAMILY LOVE COACH KIRBY. I KNOW ALOT OF U LEAVING COMMENTS FROM SECTION HAS BEEN IN ALOT MORE TROUBLE. DONT KICK SOMEONE WHEN THERE DOWN. IVE SEEN CHANNELS OUT OF LOUISIANA AND FLORIDA REPORTING ON THIS..I MEAN THE LAST TIME I GOT IN TROUBLE OUT OF STATE PAPERS DIDNT PICK IT UP. U PEOPLE ARE FORMING A LYNCH MOB. AND ONE PARENT I KNOW THAT HAS GAVE A STATEMENT SHUD BE VERY CAREFUL SPEAKING WHEN SHE IS THE POT CALLING THE KETTLE BLACK. IF YALL ARE FORMING A LYNCH MOB MAYBE SOMEONE SHUD CONTACT SOUTHERN POVERTY CENTER TO REPPORT A HATE GROUP—LEAVE KIRBY BE
