MORGAN COUNTY, Ala. (WHNT) – Jury selection began Monday for a father accused of shaking his infant daughter to death.

Gary Lee Wilbourn, 41, is charged with capital murder.  Back in 2008, he was arrested after investigators said he shook his 4-month-old daughter because she wouldn’t stop crying.

His first trial was supposed to start in February, but a judge declared a mistrial before testimony began because the defense and prosecution both had difficulties scheduling witnesses.

Wilbourn has been behind bars without bond since 2009.
