Prosecutors File Motion to Delay Hearing For Huntsville Man Charged With Sexual Abuse and Torture

HUNTSVILLE, Ala. (WHNT) – Madison County prosecutors filed a motion to continue the preliminary hearing for a man accused of holding a child captive, sexually torturing him.
Carl Phillip Herold, 32, is charged with two counts of Sodomy 1st, Aggravated Child Abuse, and three counts of Sexual Abuse of a Child Under 12.
Prosecutors filed the motion Tuesday “due to the inclement weather, the State was unable to perform necessary preparatory tasks for this matter and all other cases during the week of February 10 through February 14, 2014.”
The hearing was scheduled for February 26. The court document states the prosecution would like to delay the hearing until no earlier than March 17, 2014.
Prosecutors said they are pursuing Herold, who ran a popular online computer training class, on “various crimes of sexual violence and abuse,” according to a Jan. 3 court filing. The filing said the Madison County District Attorney’s Office will not prosecute three counts against Herold, since the child pornography production charges may be “concurrent” with other jurisdictions pursuing similar charges.
