HUNTSVILLE, Ala. (WHNT) – Court documents filed by Gunner and Richard Scarano’s attorneys reveal that there is currently a criminal investigation into Gunner Scarano relating to the wreck at the intersection of Bailey Cove and Weatherly Road in south Huntsville that claimed a young girl’s life and injured several others in May.

The filing asks a judge to stay the civil case against the Scarano father and son until the completion of a criminal investigation into Gunner Scarano’s involvement in the accident.

The civil case states that states that Amy Creech and Bailey Douglass suffered injuries and damages as a result of the accident.

Scarano’s attorney argues being involved in a civil case before any criminal proceedings against Scarano are complete would violate his constitutional right against self-incrimination.
