FRANKLIN COUNTY, Ala. (WHNT) – A Shoals man convicted of manslaughter will serve two years in prison as part of a split sentence.
Hershel Graham was found guilty of shooting and killing David Andrasik of Red Bay during an argument in November 2011.
In addition to the prison sentence, Graham will spend twelve years under supervised probation.
“This is such a tragedy, I don`t want to call it a win,” said one of Graham’s defense attorneys, Tom Freeland.
With a manslaughter conviction, the judge could have sent Graham to jail for the next two decades.
“Of course we would have preferred he be sentenced to more time in prison, and i think we speak for the family when I say they were hoping he received the maximum sentence,” said Franklin County District Attorney, Joey Rushing.
The incident happened outside Graham’s home.
He initially he faced a murder charge, but a jury convicted him of manslaughter, a lesser charge, in April.
