Couple Files Lawsuit Over New Home Location
HUNTSVILLE, Ala. (WHNT)– Some neighbors are not happy about the placement of a new home under construction on Locust Avenue in Huntsville, now the city and the builders are named in a lawsuit filed in Madison County Circuit Court.
Richard and Betty Chesnut filed the complaint this month against Denton Neimitz Reality, LLC owner of the property at 1110 Locust Avenue. The City of Huntsville, and Guild Building and Remodeling, LLC are also both named.
Chesnut claims zoning ordinances are not being followed by the city allowing the construction of the new home. Chesnut says the front of the home is very close to the front of the property on Locust Ave. “something that is out of the character of the rest of the block.”
“We really did not want this to have to go to court but after trying to work with the builder to solve this we have no choice but to have a judge decide if the zoning for our area is being followed as it is intended,” Chesnut told WHNT News 19 Thursday afternoon.
The builder, owner of the property, and the city had no comment about the pending litigation.
There is no word when the case will go before a Madison County Judge.
