The family of a Marshall County man killed by his wife is upset the suspect will not serve jail time.

Kathy Lowe pleaded guilty Wednesday to manslaughter in the 2008 fatal shooting of her husband, David Lowe.

She had two previous trials for murder, but both ended in mistrial due to hung juries.  Prosecutors said Kathy Lowe wanted her husband dead and took out extra life insurance policies in his name.

“Knowing that she is not walking away innocent, and that it’s going to be on her record and also to not get the insurance money, means a lot,” said Patricia Lowe, Kathy’s sister-in-law.  “But she should have served time.”

Manslaughter can carry up to 20 years in jail, but a judge sentenced Kathy Lowe to three years probation and a $5,000 fine.
